It's been almost two weeks, and many are still discussing and debating the Alabama Supreme Court's recent decision holding that embryos constitute "minor child(ren)" for purposes of the state's Wrongful Death of a Minor Act. There has been a mind-boggling amount of misinformation—much of it undoubtedly deliberate and willful—about this case. In reality, the majority opinion, written by Justice Jay Mitchell, engaged in straightforward legal analysis in correctly applying the underlying statute to the case at hand. Indeed, the Court actually showed judicial restraint and humility, contrary to what you might have heard on MSNBC. A colorful, Bible-quoting concurring opinion from the chief justice of the Alabama Supreme Court has garnered much attention from our religion-hating punditry class, but the chief justice was on firm ground in going that route. More broadly, the majority opinion and the concurring opinion upheld and affirmed our Anglo-American legal heritage, which has always provided ample room for God in the public square. There have been two new episodes of "The Josh Hammer Show" since our last newsletter. I was thrilled to welcome back to the show broadcasting legend Lee Habeeb, host of the nationally syndicated "Our American Stories" radio show, and welcome for the first time to the show the Dallas-based Intown Chabad's Rabbi Zvi Drizin, a long-time friend who actually co-officiated my wedding just over two months ago! I think an interesting common theme weaved its way throughout my conversations with both Lee and Rabbi Drizin: Both men are profoundly optimistic, even at a time of metastasizing human isolation, intense polarization, and partisan rancor, about the future of the United States. I wish their optimism might be a bit more contagious because I could use some more of it right now! Regarding public events, I had a fantastic time last Thursday at CPAC, the largest conservative conference in the country. I moderated and participated in a panel discussion (cheekily titled, "Would Moses Go to Harvard?") on antisemitism on university campuses in the aftermath of the Hamas pogrom of Oct. 7, and you can watch the full panel discussion here in case you missed it at the time. I will also be doing an event with the Palm Beach Freedom Institute (where I am now a fellow) in Palm Beach on Tuesday, March 12. The format will be a panel discussion, alongside Claremont Institute President Ryan Williams, on "Next Steps for an America First Agenda."
